Legal requirements for commercial on-site waste management
The Commercial Wastes Ordinance (Gewerbeabfallverordnung, GewAbfV) outlines the on-site waste management requirements for businesses. The Ordinance came into force on 1 August 2017 and has been amended several times since, most recently tightening the rules and expanding the requirements for producers and owners of commercial waste (Sections 3 para. 1 and 3, Section 4(a) GewAbfV). Under the Ordinance, reusable waste must be collected and sorted in order to extract substances that are as pure as possible. Homogenous sorting is the key to efficient recycling and therefore helps reduce the volume of non-recyclable waste. This increases the effort required of companies for sorting, recycling and documenting waste. Existing waste management concepts must be revised to comply with the law, which is sometimes unclear and ambiguous. Many companies are simply not familiar with the legal details and risk being fined.

What is a certified waste management company?
Section 56 para. 2 of the Circular Economy Act (KrWG), the implementation of the European Directive 2008/98/EC, provides a definition of a certified waste management company. For a company to obtain certification, it must meet specific requirements and have particular skills. Requirements include reliability, special expertise on the part of the business owner and staff, suitable technical equipment and the obligation to document all waste management activities. A business may perform a number of different activities, each of which is subject to strict regulations, and audited and certified separately. These activities include collection, transport, storage, treatment, reuse, trade and brokering of waste.

In which cases do companies have to appoint a waste officer?

What does a waste officer do?
A waste officer is a proven expert who is responsible for monitoring waste – from its creation to its recycling or disposal – within a company (Section 9 AbfBeauftrV). The law permits the appointment of an external expert (Section 5 AbfBeauftrV).
