The Com­mer­cial Was­tes Ordi­nan­ce (Gewer­be­ab­fall­ver­ord­nung, Gew­AbfV) out­lines the on-site was­te manage­ment requi­re­ments for busi­nesses. The Ordi­nan­ce came into force on 1 August 2017 and has been amen­ded seve­ral times sin­ce, most recent­ly tigh­tening the rules and expan­ding the requi­re­ments for pro­du­cers and owners of com­mer­cial was­te (Sec­tions 3 para. 1 and 3, Sec­tion 4(a) Gew­AbfV). Under the Ordi­nan­ce, reusable was­te must be coll­ec­ted and sor­ted in order to extra­ct sub­s­tances that are as pure as pos­si­ble. Homo­ge­nous sort­ing is the key to effi­ci­ent recy­cling and the­r­e­fo­re helps redu­ce the volu­me of non-recy­clable was­te. This increa­ses the effort requi­red of com­pa­nies for sort­ing, recy­cling and docu­men­ting was­te. Exis­ting was­te manage­ment con­cepts must be revi­sed to com­ply with the law, which is some­ti­mes unclear and ambi­guous. Many com­pa­nies are sim­ply not fami­li­ar with the legal details and risk being fined.

Sec­tion 56 para. 2 of the Cir­cu­lar Eco­no­my Act (KrWG), the imple­men­ta­ti­on of the Euro­pean Direc­ti­ve 2008/98/EC, pro­vi­des a defi­ni­ti­on of a cer­ti­fied was­te manage­ment com­pa­ny. For a com­pa­ny to obtain cer­ti­fi­ca­ti­on, it must meet spe­ci­fic requi­re­ments and have par­ti­cu­lar skills. Requi­re­ments include relia­bi­li­ty, spe­cial exper­ti­se on the part of the busi­ness owner and staff, sui­ta­ble tech­ni­cal equip­ment and the obli­ga­ti­on to docu­ment all was­te manage­ment acti­vi­ties. A busi­ness may per­form a num­ber of dif­fe­rent acti­vi­ties, each of which is sub­ject to strict regu­la­ti­ons, and audi­ted and cer­ti­fied sepa­ra­te­ly. The­se acti­vi­ties include coll­ec­tion, trans­port, sto­rage, tre­at­ment, reu­se, trade and bro­ke­ring of was­te.

A cer­ti­fied was­te manage­ment com­pa­ny is a relia­ble part­ner that is sub­ject to spe­ci­fic regu­la­ti­ons and is regu­lar­ly audi­ted and re-cer­ti­fied. This cer­ti­fi­ca­ti­on makes it easy to reco­g­ni­se a relia­ble ser­vice pro­vi­der for was­te manage­ment.

The amen­ded ver­si­on of the Was­te Manage­ment Offi­cer Ordi­nan­ce (Abfall­be­auf­trag­ten­ver­ord­nung, AbfBe­auf­trV) came into force in June 2017. It cle­ar­ly defi­nes which orga­ni­sa­ti­ons must appoint a was­te offi­cer. The­se include land­fills, hos­pi­tals and cli­nics, as well as pro­du­cers and dis­tri­bu­tors who take back spe­ci­fic amounts of sales pack­a­ging or trans­port pack­a­ging per year. A was­te offi­cer is a pro­ven expert who is respon­si­ble for moni­to­ring was­te – from its crea­ti­on to its recy­cling or dis­po­sal – within a com­pa­ny (Sec­tion 9 AbfBe­auf­trV). The law per­mits the appoint­ment of an exter­nal expert (Sec­tion 5 AbfBe­auf­trV).
